Local Nuisance and Litter Control forum

The passage of new ‘Local Nuisance and Litter Control’ legislation will soon result in fundamental reform of Local Government regulation of a wide range of subject matter.

Entirely new areas of council regulatory jurisdiction will be granted. Notably, nuisance will, for the first time, be unambiguously within the remit of councils. Further, significant changes will be enacted in respect of matters already regulated by councils. For example, litter will be expanded from its present simple concept to a multi-tiered, multi-categorised scheme applying to both public and private land.

Councils will have new offences to enforce, and new criminal and civil enforcement tools through which to pursue compliance. New prosecutorial, order-making and administrative review mechanisms will be created. These new mechanisms will co-exist alongside certain presently existing avenues, sometimes harmoniously, and sometimes potentially not.

Forum

Norman Waterhouse has closely followed the development of these reforms from draft stage, and through Parliament. We have provided advice, assisted in preparing submissions, and published numerous pieces of analysis for the Local Government sector.

Given the large-scale, novel and complex nature of these reforms, Norman Waterhouse will host a client forum to provide analysis and to explore some key aspects of the Local Nuisance and Litter Control legislation. We will also encourage questions, comments and other input from attendees, to facilitate discussion among regulatory representatives from across the sector.
