Unfair Dismissal – New Remuneration & Compensation Limits

As of 1 July 2007, the annual indexations for remuneration and compensation limits relating to unfair dismissal claims have been increased in accordance with the Workplace Relations Act 1996 (Cth) (“the Act”) and the Workplace Relations Regulations 2006 (Cth) (“the Regulations”).
 
An employee not employed under award conditions who earns more than $101,300 per year is excluded from making an application for unfair dismissal.

This amount has been indexed from $98,200 in the financial year ending 2006.

Also, pursuant to s 654 (12)(b) of the Act, the limit of compensation that may be awarded by the Australian Industrial Relations Commission (“the Commission”) in lieu of reinstatement to an employee has been increased to $50,700.

The amount has been indexed from $49,100 in the financial year ending 2006.

We encourage employers to seek further business specific advice to ensure compliance with this recent amendment to theAct and Regulations.
