Session 1: Workplace InvestigationAny complaints or misconduct of staff should be investigated. Mastering the skills of effective investigation and evidence gathering is an essential skill every HR professional and manager should have. In this session, we’ll dive into a hypothetical scenario where we provide a step-by-step guide on how to conduct a thorough and procedurally fair workplace investigation and tips on taking notes, undertaking interviews, and preparing correspondence which leads to a determination. We will also explore the rules of evidence around admissibility and the standards of proof required. Particular features of the evidence can affect whether it is firsthand evidence, whether the evidence can be corroborated by other evidence, and whether the credibility of the evidence can be held up in court. This will assist in relying on the findings from the workplace investigation if the outcome is challenged. |

Session 3: Evidence in Court and Surviving the Witness BoxFollowing the investigation, an employee has now lodged a claim against your organisation. Having been involved with the decision-making process, you are now required to give evidence in Court. In this session, we will take you through how to prepare for the witness box, how to present your evidence confidently in Court, and tips to respond to challenging cross-examination questions by a lawyer or a judge. |
