Retail & Commercial Leasing Guide required to be provided to tenants

As part of the recent amendments to the Retail and Commercial Leases Act 1995, provision was made for the Small Business Commissioner of South Australia to be able to publish an information brochure, required to be provided to tenants.

An information brochure has been published and is known as the “Retail & Commercial Leasing Guide” (Guide). It is available here.

The Guide is required to be provided by a landlord (or a person acting on behalf of a landlord) to a prospective tenant at the same time a copy of the proposed lease is provided (i.e. when negotiations are commenced and before the lease is entered into).

The Guide provides a snapshot of the Retail and Commercial Leases Act 1995 and draws a prospective tenant’s attention to key rights and obligations they may have under a lease.

The Guide is not required to be provided on renewal of the lease.
